We at Yaballe (“Yaballe”, “We”, “Our” or “Us”) have created this privacy policy (“Privacy Policy”) to demonstrate our commitment to your privacy. The following Privacy Policy discloses our information gathering and dissemination practices. offer a management tool of your online merchant accounts through our website located at yaballe.com (“Website”) and an application that may be available for download through online and mobile application platforms (jointly the “App”). The Website and the App shall be jointly referred to herein as the “Service”, unless expressly specified otherwise. By accessing or using the Service, you are accepting the practices described in this Privacy Policy.
The Yaballe end user license agreement (“Agreement”) incorporates and includes this Privacy Policy and the Terms of Use (“Terms”), which form an integral and inseparable part of the Agreement. The Terms are incorporated herein by reference. Unless expressly specified otherwise: (i) any reference to the Service in this Privacy Policy shall include any part thereof; (ii) all capitalized terms used herein shall bear the meaning ascribed to them in the Terms; and (iii) all provisions of this Privacy Policy shall apply for the benefit of: (a) any subsidiaries and/or affiliates of Yaballe, including their successors and assigns; (b) any entity controlling Yaballe; (c) any entity controlled by Yaballe; and (d) any entity in common control with Yaballe. Terms in this Privacy Policy appearing in the singular form shall include the plural form, and vice versa, and terms appearing in the masculine, feminine or neuter forms shall include all other forms, unless expressly set forth otherwise.
By joining Yaballe, or applying to any of the Services offered through the Service, you voluntarily and willingly provide Us certain information, including personally identifiable information or details which we collect in order to provide the Service, and you expressly consent to Our use and disclosure of your personal information in the manner described under this Privacy Policy. If you have any hesitation about providing information to Us, you should not you should close your account and cease using the Service.
1.    Information Collected
We collect your personal information in the following ways:
1.1.    Registration
In order to join Yaballe or apply to any of the Services (become a User), you may be required to provide us with information such as your name and e-mail address and billing information. You may also be required to choose a password. Like other passwords, you should choose one that is known only by you. If you share your password with any third party for any reason, such third party will be granted access to your account and to your personal information, and you shall be held responsible for any actions taken by such third party. Please contact Us immediately if you believe your password was discovered, hacked, or otherwise obtained by any third party unauthorized to do so.
We may request other and/or additional information from you during the registration process that We use in an attempt to provide you with a better user experience, to improve the value and quality of the Service, and to analyze how the Service is used. If you choose to register or apply for certain optional and/or additional features, products and/or services offered through the Service, you may be required to provide additional information to qualify for such features or products. You acknowledge that this information is personal to you and by creating an account on Our Service you allow others, including Us, to identify you and to allow the use of your information in accordance with provisions of the Agreement.
1.2.    Profile Information
Once you become a User, you may upload additional information to your profile. Providing additional information about yourself beyond what is minimally required at registration is entirely up to you, but doing so may enable you to derive more benefit from the Service and your network of connections. Any information you provide at registration or in the profile section may be used by Us as described in the Agreement, including for serving you more relevant advertisements on the Service.
1.3.    Customer Service
In the event you send Us correspondence, including e-mails and faxes or otherwise interact with Our customer service, We may collect such information in Our records. We may record phone calls to or from Our customer service. We may also retain copies of customer service correspondence and other correspondence sent to you. These records shall be used as described in the Terms. We have no obligation to retain the above materials, and may delete such records if applicable law allows Us to act in such a manner.
1.4.   Polls & Surveys
We may offer optional polls and surveys to Our users, in which demographic information and/or Users’ interests may be examined. The use of the information collected will be explained in detail in the poll or survey itself. If personally identifiable information is planned to be collected in these polls and surveys, Users will be notified as to the nature of the information that will be sought prior to their participation in the poll or survey.
1.5 Using the Service
We receive information when you interact with and use the Service. For example, we know when you click on ads, install and use our products, share information etc.
1.6.    Web browser Cookies
User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them.
Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.
Yaballe does not store unencrypted personally identifiable information in cookies.
1.7.    Marketing Communications
Yaballe may use contact information provided by Users for marketing purposes. For example, Yaballe may use information You provide to contact you to further discuss your interest in the Services and to send you information regarding Yaballe, its affiliates, and its partners, such as information about additional applications.
Yaballe shall not provide personally identifiable information or details to any third party ad network, if such will be available.
1.8 App’s use of information received, and App’s transfer of information to any other app, from Google APIs will adhere to Google’s Limited Use Requirements.
1.9.    Internet Communications Standards
Due to the communications standards on the Internet, when you visit the Website We automatically receive the URL of the site from which you came and the site to which you are going when you leave the Website. Additionally, advertisers receive the URL of the page you were on when you click on an ad on the Website. We also receive the internet protocol (“IP”) address of your computer (or the proxy server you use to access the World Wide Web), your computer`s operating system and type of web browser you are using, e-mail patterns, your mobile device (including your UDID) and mobile operating system (if you are accessing the App), as well as the name of your ISP or your mobile carrier and certain additional information. We may also receive location data passed to Us from third-party services or GPS-enabled devices that you have enabled. We do not share the link between your IP address and your personally identifiable information or details with third parties without your permission, except as specifically provided otherwise herein.
2.     Rights to Access, Correct, and Delete Information About You
You may review, update, correct, or delete any personal information by changing the applicable information on your profile page. If you completely delete all of this information, your account may be deactivated. If you update any of your information, we may keep a copy of the information that you originally provided to us in our archives for uses documented in this Privacy Policy. You may request deletion of your information at any time by contacting US. We will respond to your request within thirty (30) days. Please note, however that information you have shared with others, or that other Users have copied, may remain visible on the Service, or on the internet, including in search engine results, even if you request its deletion.
3.    Data Retention
We retain your information for so long as your account is active and/or as needed to provide you the Service and until the lapse of 24 months after you close your account. Please note that your personal information will be stored and processed on our computers or servers in certain jurisdictions, in accordance with such jurisdictions` applicable laws, including privacy protection laws. You can deactivate your account by entering it online and clicking on the “delete account” option or by sending Us an email to: [email protected]. We will retain and use your information as necessary to comply with any of Our legal obligations, to resolve any disputes arising out of your use of the Services, to enforce the provisions of this Agreement, to improve the Service, and to offer new features in an effort to better serve our Users.
4.    Uses of personal information & Data
4.1.    Consent to Yaballe Processing Information About You
By providing personal information to Us for the purposes of creating your User account or adding any additional details to your profile, you are expressly and voluntarily accepting the terms and conditions of the Agreement that allow Us to process information about you. You further grant us a license to all your User Content as set forth under the Terms of Use.
You have the right to withdraw your consent to Our collection and processing of your information at any time, in accordance with the terms of the Agreement by deactivating your account, but please note that your withdrawal of consent will not be retroactive.
4.2.     Communications
As further described in the Terms, we will communicate with you through e-mail, notices posted on the Service, or through other means available on the Service. We may send you a series of e-mails that help inform new Users about the features of the Service, and we may send you service messages relating to the functioning of the Service. We may also send you messages with promotional information directly or on behalf of our affiliates, unless you have opted out of receiving promotional information. If you wish, you can also opt-out of receiving promotional e-mails by sending Us a request. Please be aware that you cannot opt-out of receiving service messages from Us. Also, if We send communications to you via the carrier service with which you have a mobile communications subscription or otherwise have access, you understand you will pay any service fees associated with your receipt of messages on your mobile device (including text messaging charges).
4.3.    Customized Content
We use information you provide to us (or to third parties with whom We may offer services), to customize your experience on Our Service.
4.4.    Sharing Information with Third Parties

Notwithstanding the aforementioned, We may provide aggregated and/or statistical anonymous data about the usage of the Service to third parties for various purposes, at our sole discretion, including for the purpose of research, development of educational methods and insights and commercialization thereof as well as to prospective advertisers and ad agencies on the Service.
4.5. Statistics
We may use some or all of the information you provide us in order to perform certain statistical summaries and analysis, research and development activities, development of new Service features and improvements thereof, some of which may be presented within the Service or used outside of the Service; provided, however, that none of the above shall include any personally identifiable information or details, and you hereby waive and shall be prevented from raising any claim and/or demand from Us in this respect.
4.6 Content Distribution
Content distributed through the Service may result in displaying some of your information outside of the Service. For example, when you post User Content to your online merchant account, such content, including your user name as the contributor, may be displayed in such online merchant systems and in search engine results. We may provide aggregated anonymous data about the usage of the Service to third parties for purposes that we deem, in our sole discretion, to be appropriate, including to prospective advertisers on the Service
4.7 Links to websites
The fact that the Service links to a website or services or presents a banner ad or other type of advertisement does not mean that We endorse or authorize that third party, nor is it a representation of any affiliation with that third party. If you click on a link to a third party website or services, including on an advertisement, you will leave the Service you are using or Service you are running and will be transferred to the third party website, applications and/or services. These third party websites, applications and/or services may place their own cookies or other files on your computer or mobile device, and may collect data or solicit personal information from you. Other websites, applications and services follow different rules regarding the use and/or disclosure of your personal information you submit to them. Because We cannot control the activities of third parties, We disclaim any responsibility for any use of your personal information by such third parties, and do not guarantee that they will adhere to the same privacy and security practices as Us. You are therefore encouraged to read the privacy policies, terms of use or statements of other websites, applications and Services you visit before providing any personal information.
5.    Third Party Service Providers
We will not share your information with any third parties, except that we may disclose your personal information to third parties who perform services for us. Those third parties shall have access to a limited portion of your information only as necessary to perform their functions, and for no other purposes.
6.    Compliance with Legal Process
It is possible that We may need to disclose personal information and details, profile information and/or information about your use of the Service when required by subpoena or other legal process, or if We have a good faith belief that disclosure is necessary to (a) investigate, prevent or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (b) to enforce the Agreement, to investigate and defend ourselves against any third party claims or allegations, or to protect the security or integrity of our Services; and/or (c) to exercise or protect the rights, property or personal safety of Yaballe, Users, employees, or others.
7. International Information Transfer
We may transfer your information, including personal information to affiliated entities or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world including, without limitation, for the purpose of improving the Services and providing you with a better user experience, in order to improve the value and quality of the Services and to analyze how the Services are used. If you are located in the European Union or other regions with laws governing privacy, data collection and use that may differ from U.S. law, please note that we will not transfer your information, without your prior consent to countries outside the European Union that do not guarantee an adequate level of protection to your information according to the applicable laws in your country.
8.    Disclosures to Third Parties as the Result of a Change in Control or Sale of Yaballe
We may also disclose your personal information or details and other information you provide to another third party as part of a sale of the assets of Yaballe, a subsidiary or division thereof, or as the result of a change in control of the company. Any third party to which We transfer or sell Our assets will have the right to continue to use the personal and other information that you provided Us, shall be deemed as the sole and exclusive owner of the information (after transfer of Our assets to such third party), and shall be entitled to use such User data and information as set forth under this Privacy Policy, or in any other reasonable manner not harmful to the Users.
9.    Security
Yaballe has taken reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, it is your responsibility to protect the security of your login information. Please note that e-mails, instant messaging, and similar means of communication with other Users are not encrypted, and we strongly advise you not to communicate any confidential information through these means.
12.    Changes to Privacy Policy
We reserve the right, in our sole discretion, to revise or modify this Privacy Policy from time to time. When we post changes to this Privacy Policy, we will ask for your approval for the revised version. We encourage you to review any revised version of this Privacy Policy before providing your approval so you could be informed of how Yaballe uses and protects your information. Your approval for any revised version of this Privacy Policy shall be deemed as your full acceptance of the revised policy, with no exception. If you do not agree to be bound by all the provisions of any revised version of this Privacy Policy, you should close your account (no penalty shall apply to you if you’ll choose to close your account for this reason). Please note that your approval for any revised version of this Privacy Policy shall be deemed as your full acceptance of the revised Privacy Policy, with no exception.
